Protection of personal data

The Centre d’Études et de Recherche de l’Industrie du Béton (hereafter ‘Cerib’) places the highest value on protecting the personal data of its customers (hereafter ‘you’) and undertakes to, in the conduct of its business, ensure the protection and security of data of a personal nature (hereafter ‘personal data’). Accordingly, Cerib ensures that all its processing of personal data complies with the terms of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April, 2016, on the protection of natural persons with regard to the processing of personal data and on the free circulation of such data (General Data Protection Regulation, hereafter ‘GDPR’) and the terms of French law No. 78-17 of 6 January, 1978, on Information Technology, Data Files and Civil Liberties (amended). The present personal data protection policy lays down the principles Cerib follows to guarantee appropriate treatment of all the data of its customers.

1. Our personal-data protection

Cerib commits to the essential principles for protecting personal data:

  • Transparency: we will give you all necessary information on the intended purposes and recipients of the personal data concerning you we collect.
  • Legitimacy and relevance: we will collect and process only the personal data necessary for the stated purposes.
  • Confidentiality, security, and integrity: we will take all reasonable technical and organizational measures for protecting your personal data against disclosure, loss, alteration, or access by unauthorized third parties.
  • Storage: we will store your personal data only for the time necessary for processing or for identified purposes.
  • Exercising your rights: we allow you to exercise your rights to access, amend, and correct your personal data directly through your personal space on our website. We are at your disposal should you wish to exercise your right to erasure.

Personal data is gathered by Cerib, an industrial technical centre headquartered at 1 Rue des Longs Réages, 28230 Épernon Cedex – France, French business identification number (SIREN) 775 682 784.

3. Legal bases for processing of personal data

Cerib ensures that personal data is processed lawfully, fairly, and in a transparent manner. We may use your personal data:

  • when we have been given your prior consent in the section ‘Contact Us’ on the website https://www.cerib.com
  • when you request information from us;
  • to comply with the legal and regulatory obligations we must fulfil;
  • for the purposes of our legitimate interests; in this case, we can assure you that we will apply a strict principle of proportionality between our legitimate interest and respect for your private life.

Under these conditions, your personal data may be used for the following non-exhaustive purposes:

  • to exercise, defend, and preserve our rights, in the event of disputes for instance, and to constitute proof of possible violation of our rights;
  • to manage and enhance our customer relations;
  • to continuously improve our website (through satisfaction surveys and analysis of data gathered by means of cookies, for instance).

4. Purposes of processing personal data

The purposes of the processing performed by Cerib are for an identified and legitimate use. Providing your personal data is necessary to enable Cerib to perform customer relations management operations and operations aimed at improving its services. Your personal data is thus collected and processed chiefly in respect of a request for information, follow-up of relations of partnership such as complaints management or subscription to the Cerib newsletter. The optional or obligatory nature of the personal data to be provided is clearly indicated on the Cerib website where obligatory fields are marked with asterisks (*).

5. Nature of personal data

‘Personal data’ means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. To meet the purposes outlined in Article 4, Cerib may collect personal data, including but not restricted to:

last name; first name; address, email address; telephone number; date of birth; password; IP address; connection and browsing data.

6. Recipients of personal data

Cerib undertakes to neither sell, rent or transfer your personal data to third parties The recipients of personal data are chiefly persons within Cerib in charge of IT, administrative, marketing, partner-relations and business-development departments, as well as technical service providers such as those, for example, in charge of managing the website. Cerib may transfer some of your personal data to third parties under its contractual or legal obligations or if a legitimate interest so justifies. Our partners who have access to your personal data process it on our behalf, in accordance with our instructions. They are contractually bound to us and to respecting the confidentiality of the data received in Cerib’s name and may not under any circumstances use it for any purpose other than the performance of services for Cerib. Apart from these cases, Cerib will not share your personal data with third parties unless the law so requires and/or unless you have given express and prior permission to do so.

7. Collection of data

Our website uses Google Analytics, a web analysis service provided by Google Inc. Google Analytics uses cookies. For instance, it analyzes data on your operating system and on your the browser, your IP address, and the date and time of your visit to our website. The information generated by the cookies (text files) on the use of our website is transmitted to and stored on a Google server in the United States. Google uses this information to evaluate your use of our website and provide reports on its activity, together with other reports on the use of the website and the use of services connected to the Internet. If required to do so by law or if third parties process this data on Google’s behalf, Google will also transmit this information to said third parties. This use is anonymous and pseudonymized. 8.1. What are cookies?

Cookies are small text files that are stored on your computer, tablet or phone when you visit websites. They are widely used to improve website performance. When informing Cerib of your wish to exercise your rights, you must give your last name, first name, and email address. In accordance with regulations in force, your request must be signed and accompanied by a photocopy of an identification document (ID card, passport) bearing your signature. You should also give the address where you wish to receive the response. A response will be sent to you within no more than one (1) month of receipt of the request, barring special difficulties. In the event that you should feel that your rights in regard of the protection of your personal data have not been respected or that your personal data has been processed in a manner that is incompatible with the terms of the present policy or applicable regulations, you may lodge a complaint, either to us by the means specified above or to the Commission Nationale Informatique et Liberté (CNIL) via its website at the following address: https://www.cnil.fr/fr/plaintes (in French).

Prospect data: 3 years beyond the last prospect contact
Identification data: The time necessary for executing the contract, and in compliance with legal provisions.

Beyond the above storage times, some of your data may be archived temporarily in order to meet our legal, accounting, and fiscal obligations such as, for example, the duty to keep invoicing records for ten (10) years in application of Article L.123-22 of the French Code of Commerce.

13. Security of personal data

Cerib undertakes to ensure the security of personal data to prevent it being deformed, damaged, or communicated to unauthorized third parties. No personal information is collected or processed for purposes other than those foreseen. Cerib takes the necessary technical and organizational steps to avoid the loss, improper use, alteration, or erasure of your personal data. The personal data collected is processed with due regard to confidentiality by duly authorized Cerib personnel. Cerib also ensures that all of the service providers it calls upon for its processing requirements set up appropriate measures of protection to guarantee the integrity and confidentiality of your personal data.

14. Miscellaneous

Cerib reserves the right to modify the present Personal Data Policy at any time, while taking account of the applicable terms regarding the protection of personal data. In the event of substantial modification, you will receive an email informing you of the new provisions made.
